One common criminal charge we defend Pittsburgh clients against is driving under the influence. Recall that it is illegal to drive or be in actual physical control of a vehicle while under the influence of alcohol or drugs or if a driver is found to have the following blood alcohol contents (BAC:
- .08% or more;
- .04% or more for commercial drivers;
- .02% or more for bus drivers and drivers under the age of 21.
Note that Pennsylvania categorizes DUI offenses into 3 different penalty classes based on the BAC level – general impairment DUIs (.08%-.10%), high rate DUIs (.10%-.16%), and highest rate DUIs (.16% or more). The penalty classes determine the jail time, fines, and license suspension periods, though all defendants regardless of the penalty class must complete an alcohol and drug evaluation and up to 150 hours of community service. It may be possible for some drivers to obtain limited driving privileges during suspension if they use an ignition interlock device (IID).
